Expertsites LoanStar.net creates professionally designed websites for mortgage professionals -- customized for your company.  Below are terms and conditions for Expertsites LoanStar.net Hosting Services.  These services are made available through Expertsites LoanStar.net's parent corporation, Expertsites, Inc.

The following Terms and Conditions apply to hosting services -- not to advertising on the Expertsites LoanStar.net directories.  For Advertising Terms and Conditions, click this link. 

1. This agreement represents the web site hosting agreement and understanding between Expertsites, Inc. and the Customer and supersedes any other written or oral agreement. Upon written notice, Expertsites, Inc. may modify these terms and conditions, amplify them, and/or modify the prices, as well as discontinue or change services offered.

2. If you do not agree to these terms and conditions, please notify Expertsites, Inc. to remove your web site and close your account. Continued payments for web site hosting service shall constitute your agreement with these terms and conditions. Continuous web site hosting service is contingent upon receipt of your payment prior to the billing periods stated on invoices. You may terminate your agreement with Expertsites, Inc. upon written notice, and except for services paid one year in advance at discounted rates which are not refundable, you will be reimbursed for portions of the billing period not used. Setup and domain registration fees are not refundable. Reinstatement fees at current rates may be imposed for lapsed web site hosting service if payments are not received prior to billing periods stated on invoices. Delinquent accounts will be billed at the current rates in effect as of the date of delinquency.

3. All notices shall be written and may be sent via U.S. Mail or a delivery service or electronically by e-mail or fax.

4. Expertsites, Inc. makes no warranties of any kind, whether express or implied, for the web site service it is providing. Expertsites, Inc. also disclaims any warranty of merchantability or fitness for a particular purpose. Expertsites, Inc. will not be responsible for damages the customer suffers. This includes loss of data resulting from delays, non-deliveries, misdeliveries, or service interruptions caused by its own negligence, subscriber's errors or omissions, or due to the fault of third parties.

5. Services provided to the Customer by Expertsites, Inc. may only be used for lawful purposes. Transmission or publication of any information, data or material in violation of any U.S. Federal or state regulation or law is prohibited. This includes, but is not limited to, material protected by copyright; trade secret or any other statute; threatening material or obscene material. Customer warrants that any material submitted for publication by Expertsites, Inc. does not violate or infringe any copyright, trademark, patent, statutory common law or proprietary interest of others or contain anything obscene or libelous. Expertsites, Inc. reserves the right to remove any and all such materials at any time.

6. Customers shall not transmit any communication where the meaning of the message, or its transmission or distribution, would violate any applicable law or regulation or would likely be offensive to the recipient thereof. Sending a message, especially an advertisement, to more than five recipients, is considered “spam” unless the individuals specifically have requested to be added to a mailing list on the topic of the message. E-mail is a person-to-person medium, not a broadcast medium. Customer agrees not to send Unsolicited Advertisements, Bulk E-mail, Spam, or Unsolicited Mail Submissions that use or refer to any domain name(s) or e-mail addresses hosted by Expertsites, Inc. This includes but is not limited to using any BULK EMAIL submission software or service (for example: Cyber Promotions). Communication in a manner that is disruptive, damaging, unlawful, offensive, or intrusive as determined by Expertsites, Inc. shall be considered a breach of these Terms and Conditions and may result in immediate cancellation of service.

7. Customer agrees to defend, hold harmless and expeditiously indemnify Expertsites, Inc. from any liability, claim, loss, damage or expense arising out of the indemnifying party's breach or violation of any covenant contained in these Terms and Conditions or resulting from the Customer's use of Expertsites, Inc. services.

8. Expertsites, Inc. accounts cannot be transferred or used by anyone other than the Customer. Customers may not sell, lease, rent or assign the web site services or parts of the web site service to any other party.

9. Expertsites, Inc. reserves the right to cancel service for any reason without prior notice. In case of cancellation, unused fees may be returned to Customer on a pro-rata basis. Customer must notify Expertsites, Inc. in writing to cancel service.

10. Use of Expertsites, Inc. hosting services may involve listing Customer’s participation in relevant directories, and Customer expressly grants permission for such listings. Information contained within the web site and information transmitted via the Internet (such as feedback forms and electronic mail) are considered to be accessible by the public. Expertsites, Inc. cannot guarantee, and will not be liable for, the protection of any such information.

11. Choice of Law and Venue. This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, without giving effect to principles of conflicts of law. You agree that the exclusive venue for any disputes arising under this Agreement shall be the state and federal courts located in Maricopa County, Arizona.

12. If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable, and all other provisions are unaffected.
